MUKONO — What began as a brutal assault along the shores of Mbeya Island has evolved into a complex legal battle now drawing in the Office of the Director of Public Prosecutions (ODPP), senior police officials, and military oversight bodies.

Fredrick Namara Karuhanga, who survived a near-fatal beating in 2023, is seeking the intervention of the ODPP after he was unexpectedly added to a criminal charge sheet in a separate property destruction case — a development his lawyers describe as irregular and retaliatory.

From Victim to Accused

Namara was allegedly attacked by a group said to have been commanded by Major Mark Wanyama on Mbeya Island in Mukono District. According to his account, he was beaten unconscious, robbed of his property, and left for dead before marine soldiers intervened and rushed him for emergency medical treatment.

Following his recovery, Namara opened a criminal case under Court File 1324/2024, seeking prosecution of those he accuses of attempted murder, aggravated robbery, and assault.

However, in a dramatic turn last month, he was arrested and added to a separate case involving alleged malicious damage to property belonging to Major Wanyama. The property destruction file, registered as CRB 442/2023, had initially listed Juma Mukwana and others as suspects. Police records reportedly did not mention Namara as a suspect nor record any statement from him in the original file.

His legal team argues that the case had already been sanctioned twice before his name was introduced, raising questions about procedural propriety. They claim the move was intended to undermine his pursuit of justice in the assault case.

Police Response and ODPP Review

Police spokesperson Racheal Kawala confirmed Namara’s arrest but said he was released on bond, noting it is his constitutional right. She further stated that the file has been forwarded to the ODPP for legal guidance.

Namara has since formally petitioned the ODPP to review what he describes as an unlawful addition to the charge sheet. By press time, the prosecution authority had not publicly communicated the status of its review.

The ODPP’s decision is now widely viewed as pivotal, with observers saying it will determine whether the case proceeds, is amended, or is discontinued altogether.

Land Dispute at the Core

At the heart of the dispute lies a contested seven-acre parcel described as Kyaggwe Block 494, Plot 9, on Mbeya Island.

Records indicate the land was purchased on November 6, 2019, by businessman Jackson Twinamasiko from Francis Tyaba, a U.S.-based owner who had granted power of attorney to Joyce Lutaaya. The reported purchase price was 70 million shillings.

However, Lutaaya is said to have subsequently sold the same land to Major Wanyama, creating overlapping claims of ownership and igniting a protracted dispute.

Twinamasiko petitioned the Uganda People’s Defence Forces (UPDF) and the President, alleging forceful occupation by Wanyama and armed personnel. Investigations by military intelligence units reportedly found culpability among certain soldiers, and the matter is currently under review by the UPDF Human Rights Department.

An interim court order restrained interference with the land pending final determination of the civil suit. On October 21, 2022, the Uganda Police Force, through the Office of the Inspector General of Police, directed enforcement of that order. After reported resistance, enforcement was implemented in January 2024.

The civil matter is now before Justice Mary Kisakye Kaitesi and is expected back in court later this month.

Allegations of Intimidation

Residents of Mbeya Island describe an environment of heightened tension, with claims that armed personnel were deployed in what began as a civilian land dispute. Some community members allege mediation attempts were frustrated and court directives resisted.

The contested land remains largely unused, but the legal fallout continues to deepen.

Major Wanyama has reportedly supported media reports alleging that Namara orchestrated the demolition of his house under instructions from Twinamasiko. However, available police documentation does not list Namara among the original suspects in the destruction case.

Namara’s lawyers dismiss the allegations as an attempt to intimidate him into abandoning his complaint related to the assault.

A Test for Institutional Accountability

The unfolding developments place multiple institutions under scrutiny: the ODPP, which must assess the legality of Namara’s inclusion on the charge sheet; the UPDF Human Rights Department, reviewing findings from military intelligence; and the High Court, where the civil land dispute continues.

Legal analysts note that the case highlights broader questions about due process, protection of complainants, and the handling of land disputes involving armed actors.

For Namara, the matter extends beyond legal technicalities. After surviving what he describes as a life-threatening assault and months of medical recovery, he now faces criminal allegations he insists are unrelated to him.

As he awaits the ODPP’s determination, the Mbeya Island dispute stands as a stark illustration of how contested land transactions can escalate into multifaceted legal and human rights battles.

Whether the justice system will resolve the competing claims transparently — or deepen the controversy — remains to be seen.
